Consulting Agreements
Consulting Agreements are entered into by professional that are providing their services to another party. The services may be technical, marketing, engineering or sales or any other type of service. However, Consulting Agreements are generally used where the consultant has a specific and unique service or ability that is of value to the other party. Consulting Agreements usually provide that the parties are independent contractors, as opposed to employee-employer, and that the consultant will receive a stated monthly/yearly retainer plus commissions based on his or her performance under the Consulting Agreement.
In addition, Consulting Agreements also usually provide for confidentiality provisions regarding protection of the information of the other party, and non-compete provisions prohibiting the consultant from competing against the business of the principal.
